This Day. (Before A. C. Strode, Esq., R.M.) Civil Casks. Parke and Curie v, Sfevons. —LlO. Mr Stout for the plaintiffs j Mi- SipitJ- f. or the defendant. The defendant is captain of the E. P. Bouverie, and the action was brought to recover compensation for breakage of certain stoves. Prom the evidence it appeared that five stoves and two stove fronts were broken. Mr Smith moved for a nonsuit, on the ground that there was no proof that the .etoves were improperly stowed, and that unless that could be proved the action could not be sustained. He quoted in support of his argument a decision in tjie Magistrate’s Court in 1808, in Briscoe ail'd Co, v, flose, master of the Viola. [The case was postponed to give the defendant an opportunity of appearing.]

Williams and another v. Gore. —LSB 14s 9d, for mason work, and damage through being prevented prosecuting the work. Mr Edward Ccok for the plaintiffs ; Mr Stout for the defendant. For the deforce, a setoff for L 26 was pleaded, and not indebted for the remainder. The action was brought to recover the amount alleged to he duo for building a wool shed at the Lawlor Creek Station. The set-off was based upon a clause in the specification binding the plaintiff to complete the work within a stated time under forfeiture of a pound a day. The ease, which was not interesting, occupied flic Court several hours. [Git sitting.]
