WASTE LAND BOARD.
Mom day, Jan. 29, 1872, The Board met to-day : present the Chief Commissioner of Waste Lauds, Messrs Duncan, Hughes, and Reid, The consideration of the question of the case to be stated or settled on, in the appeal of Mr Joseph Clarke from decision of the Board, was postponed to Wednesday.
This Day. _ v The Waste Land Board met-atnooh lW'day. Present : the Chief Commissioner of Waste Lands, Messrs Duncan, Hughes, and - Reid, Mr W. S, Douglas was allowed an extension of time of three months, for surveying the antimony reef at Hindon. The survey of land applied for by Dngald Matthieson as a pre-emptive right not having been completed, through the illness of the surveyor, two months further were allowed for completing it. The land applied for by Mr H. W. Kitchener, to purchase at 10s. an acre, was directed to be put up for auction, with cost of survey added. Survey to be paid for by the purchaser. Respecting the right of the Corporation of Balclutha to interfere with the erection of a mill, it was resolved, on advice by the Provincial Solicitor, that the Board had not exceeded its powers. The memorandum of Ranger James, accompanying the request of the principal landholders that 3000 acres should not be set apart for endowment for the town of West Hawkeabury was referred to the Government. Messrs Hodgson and Howard’s application, to purchase laud under agricultural leases at Table Hill, were approved. It was resolved that a circular be sent to auctioneers to remove any doubts as to the rate of commission to be charged by the auctioneer on the sale of improvements. C. T. Marie’s application for a coal lease of five acres at Dairy Creek, was referred to the Wardpn for report. J, C. Chappie’s claim for commission was not agreed to. _____ In the case of Mr Clarke, it was resplved that the Board declines to consider any case submitted for their approval, unless the balance of the purchase money he paid within the time limited. Mr Clayton applied for a redaction of the license for a brick yard. It was resolved to reduce it to L 3. The decision of the Board having been disputed upon certain questions of law, arising upon the fact and circumstances attending the sale to Joseph Clarke of lands situate on Runs Nos. 215 and 212b, and arising upon the decisions of the Board regarding the same: Resolved—That a case stating the facts, circumstances, and decisions, and the questions of law on which this Board requires guidonce, be submitted for the opinion of his Honor Mr Justice Chapman, pursuant to the provisions of the 6th section of the Waste Land Boards Appeal Act, 1867.
