M'Quarrie, on remand, was charged with stealing a watch at Green Island on the 18th inst. Mr Stewart appeared for the accused, The defence set up was that the watch had boon stolen by another boy, and that the accused had picked it up ; and the evidence adduced on his behalf showed that he had taken it home to his mother, saying that he had found it, and she, some time before the matter reached the ears of the police, had endeavored to find an owner for it. The evidence for the prosecution was to the effect that a girl named M‘Murtrie, aged 12, had seen a boy enter the prosecutor’s hut on the day the watch was stolen, and from her description, Constable Turnbull arrested the accused. His Worship considered that the circumstances pointed to the accused having taken the watch; but, agreeing with the passage from Judge Johnston’s work, cited by Mr Stewart, which laid down that “magistrates, before committing a fthild under 14, ought to take care that there is clear evidence of sufficient understanding or malice to manifest ft discretion to do mischief,” dismissed the cage.
