RESIDENT MAGISTRATE’S COURT.
This Day. (Before A, C. Strode, Esip, R.M.) Civil Cases, Barton v. Pope.—L4 ss, a claim for professional services. Mr Saunders for the plaintiff. This case had been adjourned to obtain the evidence of Mr M'Keay, who said he was solicitor to a person named M'Carty, who was summoned by Pope, and that Pope and McCarthy went to his office, and said that they wished to settle the case. He replied that as Mr Barton was engaged on behalf of Pope, lie (witness) could not settle the matter until lie knew what was due to Mr Barton. He sent to Mr Barton’s office to ascertain his costs, but no one was ip, and the case was settled on condition that M‘ was to pay Mr Barton’s costs. The sum of I g was left with him for Mr Barton, which was sent tp his office, and refused on the ground of a special agreement with Pope for L 5. William Blair'and Mr Saunders proved the agreement with Mr Barton, and judgment was given for the plaintiff for the amount, with costs. jffowffen and Co. v. Frank Anderson.— L 8 6s 2d, fpr balance of account. Mr Bathgate for the plaintiffs. Judgment by default for the plaintiffs for tfa t e amount, with costs, Menzies v. James Bell— Ro 9s kl Judgment by default for the plaintiff, with costs. M'Liskey v. Meldrum.—L3 I2s, balance of account for goods supplied. Judgment by default for the plaintiff for the amount, with costs.
