RESIDENT MAGISTRATE’S COURT.
This Day, (Before A. C. Strode, Esq., R.M.) CIVIIi CAS*,?. Trotter v. M undell.—L7 4s, for balance of one mouth’s wages on board the steamer Samson, as fireman, The case, according to the evidence of the plaintiff, was that on the 3rd November, while in Auckland, the plaintiff was engaged as fireman by the engineer of the vessel. On arrival at Duncdiu be was paid LI lbs and discharged. 'I he defendant is master of the vessel. T. H. Davison, engineer of the steamer Samson, said the pi intiff went on board at Auckland to obtain some money of one of the men, and was taken away, saying that he wished to go to Port Chalmers. After being on hoard a short time, he was asked if he could “ lire,” and on his answering “Yes,” ho was engaged at L 9 a month, conditionally that he understood the work ; but on trial it was found he eodd not keep the steam up. On arrival LI 16s was given him, which was the full value of his work. This was confirmed by an experienced fireman flis Worship considered the payment sufficient, taking the circum tances into consideration. Judgment for the defendant.
