ITY OF DUNEDIN 7 .—BYE LAW NUMBER IX. A Bye-Law of the Council of the C ity of Dunedin, made under Sections 186 and 361 of the “ Municipal Corporations Act, 1867.” A Bye-Law for Eeoulatino the Cattle and Sheep Market of the Corporation < f the City of Dunedin. In pursuance of the powers and provisions contained in Section 361, Part XXL, and in Section 186 of Part XIII of the “ Municipal Corporations Act, 1567,” the Council of tlie City of Dunedin ordain as follows, th it is to say : Ist. That the Cattle and Sheep Market of the Council of the City of Dunedin (hereinafter referred to as the “ Market ”) covering all that area comprising the southern half of the Cattle Market Deserve, an laid down on the Record Map of the City of Dunedin, and situate in the Town Belt of Dunedin on the south side of Maclaggau-street Extension commonly known as the Serpentine Avenue, shall be open for the reception and deliviry of Cattle and other Live Stock on Friday in | each week, and on such other days as the said' Council may from time to time by any i resolution direct, until 10 o’clock post meridian, subject to such rules and regulations as may be ordered by the said Council in that behalf. 2nd. That there shall he appointed for such Cattle Market an Officer, to be called the Inspector thereof, whose duties shall be as follow: Ist. To see that the Market Eegulations be duly observed. 2nd, To demand and receive all Market Tolls and Dues. 3rd. To .allot the principal and drafting yards to the use of the parties bringing .Stock to the Market for sale, in such manner as in each particular case may seem to such Inspector to he most convenient. 4th. To preserve order and cleanliness within such Market, and to summarily eject therefrom any person creating a riot or disturbance, or cursing or swearing, or using any gross or indecent language, or being guilty of any gross or indecent conduct therein. 3rd. That any person or persons who may obstruct the inspector or his Assistants in the performance of his or their duty, or shall release any Stock from the Market, or shall remove the same from one part of the Market to another without the authority of the Inspector, or shall wilfully break down or damage any of the gates, fences, or premises of the Market, shall forfeit and pay, for every such offence, any sum not exceeding (1.5) live pounds, 4th. That the party or parties placing stock in the Market for sale shall be responsible for all Market Dues and Tolls accruing thereon, and hi no case shall any stock he taken out of the Market until all Dues Tolls, a d Charges demandable on such stock under this Bye-law shall have been first fully paid and satisfied. sth. That any person or persons who may place stock in the Market for sale, and neglect for (2) two whole days to supply such stick with sufficient food and water, shall for every such offence, forfeit and pay for every head of such stock any sum not exceeding (5) five pounds. Gth. That the following Tolls or Dues he, demanded, paid, and taken at the said Cattle Market for all stock sold or exposed for sale therein—that; is to say, for every horse, mare, gilding, foal, ass, or mule, the sum of (Is) one shilling : for every head of neat cattle, the sum of (Gd) sixpence ; and for evt ry sheep, lamb, pig, or goat, the sum of (Id) one penny, 7th. '.I hat the following charges shall be made by the Inspector for stock occupying the Yards for any time between 10 o’clock post meridian ami midnight, that is to say—- ■ for every horse, mai c, gelding, foal, ass, or I mule, the sum of (Is) one shilling per night; for every head of neat cattle, the sum of (3d) threepence per night; for sheep, lambs, pigs, or goats, the sum of (Gd) sixpence per score ; and proportionally for any smaller number for every night during which tiny shall be so yarded. Blb. That the following charges shall be made by the Inspector for the use of the Branding Yards—that is to say, for every horse, mare, gelding, foal, ass, mule, or steer branded therein, the sum of (6d) sixpence ; and for eacli steer yoked therein, the sum of (Is) one shil'ing. 9th. That sales of stock by auction in the said Cattle Market shall fake place in order of priority of the arrival of such stock within the Cattle Market Reserve, and n port of such arrival to the Market Inspector by the person or any of the persons in charge ©f such stock after the opening of the Market on Friday, and that it shall be the duty of the Market Inspector to certify and direct the precedence and succession of such sales in the order of such reports, in accordance with this Bye law ; and any person or persons who shall sell any such stock by auction, contrary and in disregard to such directions, shall be deemed guilty of obstructing the Inspector in the discharge of his duty, and shall be subject to pay, upon conviction thereof, any sum not exceeding (L 5) five pounds. 10th. Notwithstanding anything hereinbefore contained as to hours during which the Market shall be open, the Market Inspector shall at all times give such facilities for the reception and delivery of stock, as for complianc i with the provisions of Regulation No. IV of the Council of the City of Dunedin, made under the authority of Section 45, Subdivision 9, Part 1 of Schedule XIII of the “Municipal Corporations Act, 18(57,” entitled a Regulation for appointing the hours during which it shall not be lawful to diive into or through the City, or any part thereof, any cattle intended for sale, slaughter, or shipment, or travelling from one part of New Zealand, or of any other Colony, to any other place, &c., &c., or of any other Municipal Bye-law, may in any case be actually necessary.
