Rodgers—L2 7s 3d for goods sold and delivered. Judgment by default for the amount claimed with costs. Forester v. Gordon.—A claim of L 5 12s for cash lent. The defendant admitted owing I2s, but denied having borrowed the L 5. The plaintiff stated that the defendant was married to his sister, and some time back was in Melbourne, and a young man came to him with a message from him stating that he was hard up, and he (the plaintiff) sent him five pounds. The defendant stated that the plaintiff sent L 5 to his wife when she was in Victoria. It was sent as a present to her for past services. The defendant’s wife was called, and stated that she received a postoffice order for L 5 from the plaintiff (her brother). She considered it was for past services rendered to plaintiff when he was a boy. She produced a letter written by the plaintiff, in which he stated that he enclosed a post office order for L 5, which would be a little assistance to them. Judgment for plaintiff for 12s with costs.
