RESIDENT MAGISTRATE’S COURT,
This Day. (Before A. C. Strode, Esq., R.M.) Civil Cases. Walker v. Bandeau.—L2 17a 5d for goods sold and delivered. Judgment for the plaintiff by default for the amount with costs, John M'Laren v. Rodgers—L2 7s 3d for goods sold and delivered. Judgment by default for the amount claimed with costs. Forester v. Gordon.—A claim of L 5 12s for cash lent. The defendant admitted owing I2s, but denied having borrowed the L 5. The plaintiff stated that the defendant was married to his sister, and some time back was in Melbourne, and a young man came to him with a message from him stating that he was hard up, and he (the plaintiff) sent him five pounds. The defendant stated that the plaintiff sent L 5 to his wife when she was in Victoria. It was sent as a present to her for past services. The defendant’s wife was called, and stated that she received a postoffice order for L 5 from the plaintiff (her brother). She considered it was for past services rendered to plaintiff when he was a boy. She produced a letter written by the plaintiff, in which he stated that he enclosed a post office order for L 5, which would be a little assistance to them. Judgment for plaintiff for 12s with costs. Summonses were issued iu eleven cases of which one was adjourned, one was not served, and the remainder, not heard, were settled out of Court.
