This Day. (Before A. C. Strode, Esq., 8.M.) Civil Casks. Tntcbon v. Hill. |L2O for three months hire of a horse and dray. Mr Stout for the defendant pleaded never indebted. The plaintiff said that be had agreed to provide a horse and dray for the defendant, m payment of which he took an acceptance, during the currency of which he had made use of and retired j it, and taken ba-k the horse and cart. The plaintiff was necessarily non-suited.

Two cases were struck out for non-ap' pcarance of the parties.
