DE CARLE v. STAMPER.

Sir, — You will very much oblige me by inserting the folio win ' in 2'ke Evening Star, as 'The Daily 'Times has refused to do so. My attention has been called to the report in 'The Otago Daily 'Times of the ca e “De Carle against Stamper,” no doubt, properly decided in my favour, as supported by the legal authorities on the subject. I, however, perceive an e.c parte statement, (and therefore, so far, highly improper and injurious) tint “ Dir. hi. F. Ward said he denied owing Mr. Stamper anything’; that “ the alleged debt to Mr. Stamper did not exist.” I beg, through tho medium of your columns to observe such a statement is easily, only too easily, made. lam sorry to read it; but be having bad by account several times delivered, and made payments on account, having arranged to sa’isfy the balance, and never mentioned it since, it may naturally enough be asked, why did he withhold his <ivuial until jnuw, after I had bought myself out and got possession at the auction of his books? I otherwise respect Mr. Ward, and if he will become plaintiff in an action (and seeing his denial, I kindly invite him to do so), then the public will judge between us as to his denial; elJialjusiitia.
