SUPREME COURT.
IN BANCO.
This Day. (Before Mr Justice Chapman.) FULLER V. MURRAY. In this nntter, Mr Barton obtained a rule am calling upon Fuller to slpny cause why he should not pay the sum of 83 8s 3d, costs in the cause. BOSS V CHAPLIN. Mr Macassey said he would not trouble the Court with any argument herein. He admitted the ruling of his Honor was as favorable as any Judge could give, unless he was prepared to go the length which he (Mr Macassey) had hitherto contended, upon the single point in dispute. His Honor had thought the matter over since. The question was one for the jury; he could not direct them to find for the plaintiff as Mr Macassey desired. Mr Macassey suggested that the exceptions shoul I bo ovenuled, which would enable the plaintiff to take the matter into another Court. His Honor promised to look into the matter, and give a decision in writing, Mr Barton applied for a rule nm, calling upon Henry Driver and James Macandrew to show cause why an information should not be filed against them. His Honor said that, as the matter hud a political aspect, he would suggest to counsel the propriety of postponing it until after the Superintondental election. Counsel for M r Driver having consented to postpone certain proceedings now pending in the Magistrate’s Court, Mr Barton said he would abstain for the present from proceeding with the motion. Several other matters were postponed, and the Court adjourned until Friday.
