Civil Cases,

Mills, Dick, aud Lister v. Fraser. —A claim for the price of advertising in the map of Dunedin lately pubbshed by them, L2 10s. The claim was resisted on the ground that the map was not published until too late for tbo advertisement to be of service, and that it was promised to have been brought out before Christmas, but did not appear until some time afterwards. The defendant admitted that Mr Lyster said the map, if possible, should be published before Christmas. Judgment for the plaintiff for the amount with costs. Clappartou v. Milton. —L 7 10s. This was a claim for balance of account incurred in 18(38. The debt was admitted. Judgment by consent for the plaintiff for the amount with costs. Banbury v. Peyton.—The defendant was summoned to show cause why he refused to deliver up a dwelling house in his occupation, There was also a claim for L 4 8s for rent. The wife of the defendant appeared aud expressed willingness to give possession, but objected to the rent as being 12 4s in excess of what was owing. Judgment for the plaintiff, L 4 8s for rent with costs, and the promisee to be delivered forthwith. The following cases were decide,l in favor of the plaintiffs by default: —Pa’mer v. Mooney, Ll4 4s 7d; same v. Macdonald, LlO 14s; Freidlitch v. 1-lerringshaw, L 4 19s 9d; Watson and Gow v. Hutcheson, Lll 10s.
