This Day. (Before A, C. Strode, Esq., R. M.) SINGULAR CASE. Henry Moore was called to answer an information laid by H. Scott to recover possession of a saddle and breastplate bought by him of one Thomas Jones, late of the Otago Hotel, the articles being the property of the informant. Mr Howorth for the defence. It appeared that Jones owed Scott money, and in liquidation of the debt he transferred to him a horse and the articles in dispute, the balance being paid to Jones in cash. One day last week Jones fetched the saddle and breastplate from Scott and on Saturday sold them to Moore, who paid Lll for them. Jones left the country on Saturday. Scott’s groom stated that Jones, on Wednesday, fetched the saddle and breastplate away, refusing to wait the return of Scott Application -was made to Jones for the saddle, who refused to give it up, and proceedings were taken against him to recover it. His Worship said it appeared to him that Scott had a prior title to the goods. Unfortunately, one of two innocent persons must suffer through the misconduct of a rascal. Moore must suffer through not having been especially careful in dealing with Jones, and the saddle and breastplate must be returned to Scott.
