This Day. (Before A. C. Strode, Esq., E,M.) Civil Cases, Levy v. Hensley—L9 10s, for goods supplied. Judgment by default for plaintiff for the amount.

O'Neil v. Kitchener—L2 Os 10d, balance of account for goods supplied. Judgment by default for the plaintiff for the amount. Same v. Robert Scott—Balance of 13s. This was a claim for 18s for a load of wood and a packet of scdlitz powders, of which 5s had been paid. From the evidence of the plaintiff, the defendant was living in the house of a woman named Anderson, and the goods were ordered by her. The defendant said Mrs Anderson denied having had the goods, or he would have paid the debt. His Worship said there could not be the slightest doubt about the defendant’s liability, as the law provided that if a man cohabit with a woman and allow her to pass as his wife, not being married to her, he is equally liable for the debts she may contract as if she were his wife. The defendant pro luced ar.ce p L for 13s, which he alleged was a discharge of the sum charged for wood. The case was subse<junitly settled out of Court. 11. H. Bailey v. Fitzroy M'Lcan.—A c’aim for 17s Gd for a lever timepiece. The plaintiff is a watchmaker, andjsold a timepiece to defendant for the rum mentioned. Judgment by default for the plaintiff. F. P. Mansfield v. 11. Walker.—Lll 17s for balance due on a dishonored bill of exchange for BIG 12s Gd and interest from June 20th to August 16th at 12.J per cent. L 5 had been received on account. The plaintiff said the rate of interest was positively arranged to be paid by the defendant. Judgment by default for the plain'iff with costs. C. Sampson v. James Murdoch. The summons not having been personally served, the case was dismissed. Two other cases were dismissed on similar grounds of nonpersonal service. Sutherland v. Woodmore. —LI 18s Gd. There was a further sum charged for interest which, not being specially agreed upon, was not allowed. The defendant admitted the debt. Judgment by consent for the plaintiff with costs.
