• ' This Day. (Before his Worship the Mayor and G. Lloyd, Esq.. J.P.) DRUNKENNESS. Thos. Dnncan was fined ss; Samuel Robinson, and John Harris 10s each ; and John M‘Donald, who did not appear, had his bail forfeited. John Harris was also fined 10s, for being drunk while in charge of a horse and dray, INDECENCY. James Baird was charged with this offence It appeared from the statements made that the prisiouer had gone to the Balmoral Eating house, Rattray street, perfectly sober, and calling into the room in winch he was, the wife of the proprietor, committed the offence with which he was charged. _ The prosecutor stated that ho did not wish to proceed, the prisoner having made an ample apology. The Commissioner of Police pointed out that there was a feature in the case, which made it one of an aggravated nature. The prosecutor had expressed a wish to the police to forego the prosecution, but that was a matter exclusively for the Bench. The prisoner was a hard working man on the wharf, and he ought to have known better. Could he (the Commissioner) have gone back ten months, ho conld have proved the prisoner committed a similar offence, in the same way, in the presence of another woman; but the Act provided that the information should he laid within six months after the commission of the offence. The Bench had a doubt as to ■whether the place in which the offence was committed was one of public resort, within the meaning of the Act, and on that ground discharged the prisoner.
