Ingram—LlS 13s. Judgment for plaintiff by default. In Carey v. Ellis, LIS.s; Sibbaldv. Fuller, LI Is ; and same v. Blair, the plaintiffs were non-suited. Four cases were dismissed for non-appear-ance, and eleven withdrawn before the opening of the Court. •iriKiMKXT. Attwood v. Barr.—His Worship gave judgment in this case as follows “ In this case I had some doubts at the hearing whether the defendant should have been rated for tho land referred to in the plaint, owing to his having disposed of the property prior to tho assessment being made ; but f have come to the conclusion that tho land not having I>een properly conveyed by the defendant to the purchaser, the legal estate remained in him (the defendant), and consequently he was still the owner in tho sense that word is used in the 32nd and 33rd sections of the Otago Roads Ordinance,

1865. By tho 38th section of that Ordinance, the owner is made primarily liable for the payment of the rate, and therefore I must hold the plaintiff liable to recover ” Judgment for the plaintiff, L 5, together with costs.
