Tins Day. (Before A.C. Strode, Esq., R.M.) Civil Cases. The cases of Yates v, Perguapon, Davis v. Hankins, wore by consent adjourned until Monday, the 13th instant. Oliver and Clph v. Henry.—This was a claim for LG 18s Gd, for goods sold and delivered, The defence was that the contract had not been carried out in accordance with the terms agreed upon by the defendant and the plaintiff’s representative. traveller being absent from is an important witness, the ease was adjourned to Wednesday, sth January, 1870. Macandrew v. Margaret Naylor. This case was one of the non-payment of the money advanced by the Provincial Government under the Assisted Immigration Act. Mr Haggett appeared for the plaintiff. There was no defence. Judgment for plaintiff for the amount claimed with interest to date, viz., L 6 17s Gd. Same v. J. Buchannan,—ln this case the plaintiff sued the defendant for the sum of LT4, being tbe amount due upon bonds held by the government as payment in part of one Ellon Walker and another. Mr Ward appeared for the defence and objected to the jurisdiction of the Court, the defendant not being a resident of Qtago. Major Croker proved that the orders had . been obtained

from him at Lawrence. Ellen Walker having been called as a witness for the plaintiff, and not appearing, Mr Haggett asked for ah adjournment as he contemplated taking proceedings against the absent witness. Adjourned till Wednesday, Jan. sth, Haggett v. A. Mackay.—No appearance of defendant. Judgment for plaintiff, LI3 os. Wilson v Boden.—No appearance. Judgment for plaintiff, Llo 4s 2d. M'Lennan v. Kitchen. This was a claim for L2 5s fid, for accommodation to one John Fergusson on defendant’s authority. Judgment for plaintiff, LI 17s fid. The case ef M‘Lean v. Cohen, for illegal occupation of a house, was dismissed. Proudfoot v. Campbell.—Adjourned until Monday next.
