To the Editor of the Evening Star. Sir, —In your paper of yesterday evening you spoke of this prosecution as the “ pending prosecution You are under a mistake. The prosecution lately commenced by Mr Maclean is at an end, and if that gentleman or Mr Driver think proper to begin again, their proceedings will be fresh proceedings, not a continuation of the old proceedings. Whether such fresh proceedings can be taken is a question, but there can be no question that Mr Henningham stands discharged from the late proceedings, which have terminated.
