THIS HAY. (Before A. C. Strode, Esq., E..M. James Richard Williams was charged by Isabella Jenkinson with failing to support his illegitamate child. As the complainant did not appear, the case was understood to have been dismissed. CIVIL CASES. Edward Shields v Berrill and Bond, claim of Ell 16s 9d for lighterage. This case, owing to the perverseness of the witnesses, occupied a considerable time. An error having been found in the bill of particulars, and rectified, the defendants Consented to judgment in the sum of Ell Is and costs. Berrill and Bond v. Edward Shields—claim of Ll9 19s lid for short delivery of potatoes. The plaintiff’s case was that 480 bags of potatoes had been shipped oil' board the defendant’s lighter for transhipment to the steamer Hero, for Melbourne. The defendant, however, delivered only 460 bags, the majority of which had been damaged by salt water whilst being conveyed by the lighter to the steamer. The defence was that the potatoes had been lightered for Messrs Breuchley and Rushton. Mr Brenchley stated that he had been only acting as agent for the plaintiffs. Judgment was given for the amount and costs. James Newman v. Sydney Smith, claim of L 3 11s lid for meat. The debt was admitted, but it was pleaded that it was a matter of barter, inasmuch as the plaintiff had agreed to take in exchange for the value of the meat, a quantity of pork. It appeared, however, that the arrangement which was to have supplied the pork within 14 days, had not been carried into effect. Judgment was given for the amount and costs, to be paid within a fortnight. A. MTlroy v. T. Basset, claim of L 6 10s, amount of an 1.0. U. Judgment by default was given for the amount and costs. The case of Ireland v. M'Kinnonie was dismissed, there being no appearance of either ' party.
