OVER £5000 CLAIMED

SEQUEL TO ACCIDENT

MOTOR-CYCLE AND CAR

CHRISTCHURCH, This Day,

A claim for £5000 general damages and £122 15s special damages was brought in the Supreme Court today by Peter Brooky, aged 24, cabinetmaker, of Wellington, against Frederick George Lynch, hotelkeeper, -of Reef ton, for injuries received in a collision between his motor-cycle and Lynch's car on the Buller Gorge Road, between Inangahua Junction and Westport, at about 7.45 p.m. on December 27. The case is being heard by, Mr. Justice Northcroft and a full jury.

When the accident occurred, said Brooky in his statement of claim, he was riding from Nelson to Westport and met Lynch's car coming in the opposite direction. He claimed that the collision was due to the negligence or recklessness on the part of Lynch in failing to drive on his correct side of the road, in failing to keep as close as practicable on the left side of the road, in failing to keep a proper or adequate lookout, in driving at a speed which was, in the circumstances, too fast, and in failing to have his car under proper control.

As a result of the accident, said Brooky, he suffered severe injuries, necessitating the amputation of ais right arm. He was now fully incapacitated, and would remain so for an indefinite time. The case is proceeding. steamer returned from -the football match at about 5 p.m., went to the hotel, and consumed liquor until 6 p.m. When they came out they wailed for some time, and then got into the car to wait until Kendrick arrived. The accused said he did not attempt to drive the car, had no intention of driving it, and was merely waiting for Kendrick to take charge of it and drive the men to the ship. Evidence along these lines was called.
