The statement of claim said that Fitzgerald was employed as a tyre, re- » pair hand and was buffing a tyre .on , an electrically-driven buffing wheel when the tyre became entangled in the teeth of the wheel and dragged him on to the wheel. He suffered a' deep laceration on the left thigh, which. . necessitated ,two operations and kept him in bed for sixty-two weeks, and caused a permanent 'partial' disability. He alleged that' the defendant com- • pany was negligent in.instructing him to hold tyres, round his waist white , buffing.
