FINED FOR ASSAULT
BET AFTER A RACE
A REFUSAL TO PAY

! "The £10 was a bet on Gay Vixen, but I think on this occasion it was a "sly fox," " said Mr. W. Meek, defending a bricklayer, John Rowland Howe, who admitted a charge in the Police Court of having assaulted Eric Ashby on October 27. Gay Vixen won at Gore on October 22 and paid the limit, but Ashby did not get paid. The police said that Howe apparently had been bookmaking. Ashby, who had put £5 each way on the horse, called at Howe's house and claimed £60. Howe said he had no intention of paying tine bei, as Ashby had telephoned after the race had been run. Words ensued and Howe kicked Ashby on 1 the shin and groin. Ashby complained to the police. . Mr. Meek said that Ashby telephoned Howe's" wife at 3.35 and put £10 on the horse. Mrs. Howe accepted the bet but later found that the race was run at 3.10. Ashby had never before had a bet with Howe. When Ashby called Howe was very drunk and did not remember much of what happened. The Magistrate. Mr. Orr Walker, said that there must have been aggravation and fined Howe £5.
