APPEAL DISMISSED

CHRISTCHURCH, January 25. The appeal lodged by Mr. C. Johnston, owner of De Soto, against the disqualification of three months imposed on his horse, by the New Brighton Trotting Club, has been dismissed. The judgment of the appeal judges—Messrs. A. T. Donnelly, D. E. Wanklyn, and A. S. Duncan—is as follows: —"After hearing the parties we are unanimous in dismissing the appeal of Charles Johnston against the dis- j qualification of the horse De Soto. As | a general rule disqualification for a period of three months should not be regarded as sufficient penalty for a breach of rule 310. There are special circumstances in this case which were taken into consideration by the stewards of the New Brighton Trotting Club and New Zealand Trotting Association, and on account of these circumstances we do not make any variation in the penalty imposed."
