KING'S BIRTHDAY
HOLIDAYS AND PAY
.In a circular to members of the Wellington Employers' Association, the secretary (Mr. W. J. Mountjoy) recalls that in the Gazette proclaiming the holiday, issued by the Minister of Internal Affairs (the Hon. W. E. Parry) on April 14, it was notified for general information that the holiday will be observed on Wednesday, June 9, instead of the actual date, December 14.
' Giving advice regarding the question of payment for the holiday where it is necessary, Mr. Mountjoy says:—
■ "Under the Factories Act, 1921-22, and its amendments, the Sovereign's Birthday is a holiday and t payment must be made to all workers'who have been employed in a factory for at least four days during the week ending on June 9, 1937. Workers employed on Wednesday next shall, in addition to the payment to which they are entitled, be paid therefore not less than double the ordinary rate.' "The Shops and Offices Act, 1921-22, includes the Sovereign's Birthday as a special day, but unless workers employed in shops and offices are covered by an award that requires an extra payment for the Sovereign's Birthday, overtime payment is not necessary. "In addition to the requirements of the Factories Act, 1921-22, and its amendments, and the' Shops and Offices Act, 1921-22, and* its amendments, the Sovereign's Birthday is included as a holiday in many awards of the Court of Arbitration, and work done on the Sovereign's Birthday must be paid for at overtime rates in accordance with the requirements of the respective award or awards. "Shops that are required to be closed under the provisions of any award on the Sovereign's Birthday must be closed on Wednesday next."
