STATE OF DISREPAIR

HUTT ROAD CYCLE TRACK

COMPLAINT. IN COURT

Criticism of the state of disrepair of the Hutt Road cycle track was voiced in the Magistrate's Court today when Reginald Hullena was charged with riding a bicycle on the bitumen of the Hutt Road.

Counsel for the defendant, Mr. A. M. Hollings, 'said that Hullena -had no alternative but to plead guilty to riding on the bitumen, but the condition of the cycle track was such as to suggest a > test case on the question whether the bylaw was not unreasonable. ' There had. apparently been a suggestion of a test case when the defendant was originally stopped by the traffic officer. The defendant said that on the same • day many other cyclists had been riding on the bitumen, and he' felt that he had been singled out. The cycle' track was in places in a -terrible condition and: was not fit in those ■ parts" for cyclists to ride on. ,' Mr. A. R. Cooper, for the City Council, said that the present case could not be considered a test case, as the bylaw had been attacked in 1928 or 1929. He conceded that the track was not in such a good condition as the "road. Mr. E. D. Mosley, SM.: Yes, in parts it is rough. ■•'■. •
