CULPRIT GIVEN A CHANCE

; "From a room at the rear of the shop a hand was seen closing on the money in the till," said Senior-Sergeant J. Dempsey in the Magistrate's Court today when John Doyle, a clerk, was charged before Mr. E. D. Mosley, S.M., with theft of 11s from a shop till and with a breach of a prohibition order.

Senior-Sergeant Dempsey said that the defendant entered a small confectionery shop in Vivian Street on Saturday afternoon. When the hand was seen going into the till, the proprietor ran out from the fear of the shop and caught the defendant, who was then putting his hand into his coat pocket. The money was returned.

Mr. P. Verschaffelt, who appeared for the defendant, said that Doyle had met some companions on Saturday and they had persuaded him to drink. He had gone into the shop to get some soda water and finding the till open had succumbed to the temptation. The defendant was married, and this was the first occasion on which he had drunk liquor since he had taken out the prohibition order.

"On the theft charge I am going to give you a chance and I recommend you to get work out of Wellington, and to get away from your friends here,", said Mr. Mosley. He convicted the defendant and ordered him to come up for sentence if called upon within six months. On the charge of breach, of the prohibition order, the defendant was convicted and discharged.
