HEAVY PINES IMPOSED

MAGISTRATE'S WARNING

r '"rhe, only'question that disturbs my mindisasvto whether I shall impose the maximum terms of imprisonment on-thesetwo men," said Mr. E. D. Mosley, ;S.M.. in the Magistrate's Court today,, at the, conclusion of the .hearing of■ thevcase in which Herbert Cyril Baiyhe'.'and Norman "Charles Fox were each charged, with;-beiri,e.found In possession.of indecent-documents (book-. lets, and; photographs) for saie. Mr/ M.' Sutherland • appeared- for the accused, and •Detective-Sergeant L. B. Hevell conducted the prosecution.

Detective-Sergeant Kevell said that Fox was the proprietor of the National Sales Co.' and .dealt in chemists' supplies..! The accused Bayne' was employed, as a salesman. -

"Cases-like this, are happily very few in this country," said the Magistrate after hearing evidence. "It is three years since a similar case came under my notice. There are evidently quite a number of these documents circulating in Wellington, and that speaks very poorly for the men of the city. This time," said' Mr. Mosley, addressing the accused, "I shall give you the benefit of a monetary penalty. In the future, however, there will be only one penalty—imprisonment. The debauching of the citizens of Wellington by the circulation of such photographs is not for a moment to be tolerated."

Bayne was fined £25 and costs, and Fox £50 and costs. The Magistrate directed that: in the event of the fines not being paid, the maximum term of imprisonment should be imposed. Seven days were given in which, to pay. The documents were ordered to be destroyed.-
