£807 IN SILVER
ATTEMPT TO EXPORT
FORFEIT TO THE CROWN

AUCKLAND, October 11,
Final steps were taken in the Supreme- Court to determine the ownership of £807 in silver which was stolen from a motor-car at Wanganui in June of last year. The money was claimed by tho Crown, iv whose possession it was, on the ground that its owner was attempting to export it from the Dominion, and that it was therefore liable to seizure. '
Tho Solicitor-General took proceedings by way of "information in rem" to claim tho silver, tho ownership of which was also claimed by William Toomey; of Auckland.
Mr. justice Ostler said that in his opinion the evidence! clearly proved Toomey's intention to export the silver contrary to the regulations. He "was convinced that Toomey> was engaged in an organised business to export silver for profit. The Crown had not only shown that intention, but also that overt acts had been done. Toomey's proved acts went far beyond preparation, and amounted to an 'attempt. There would be an order declaring forfeiture of the. silver to the Crown.
