CASE AT PETONE

LICENSEE'S NEPHEW FINED

I Charged with selling .liquor at s. timo when tho premises' were required by law to be- closed, Clarence Neale pleaded not guilty before Mr. J. G. L. Hewitt, S.M., in the Petone Court today, but after the case had been heard he was convicted and fined £2. ■ Mr. C. R. Barrett represented the defendant, and Senior-Sergeant C. E. Roach prosecuted. ■ Senior-Sergeant Roach' said that about 9.10 p.m. on March : 3 Constable Moore was'passing the New Central Hotel in Jackson Street when two men came out with" bottles of beer under their coats: The constable took the men back into the hotel, and they pointed out to him a man whom they said had served them with tho beer. Victor A. Nicholson and John A. Sterroek stated they obtained liquor at the hotel. "When asked if Neale, who was in Court, was the man who had served them, they said they could.not be certain. " '.;-, " Constable^ J. L. Moore said that after he accosted the men they denied having •bought the liquor at the New Central Hotel, but said they, had' bought it before 6 p.m. They said they had been into the hotel to, see a man, but had been informed by a man that'he was not there. : When taken into the hotel, the men pointed Neale out as the man to whon< they had been ' speaking. Later, when taken to the. police station, tho men admitted that ; they had bought liquor at, tho : hotel, and said the man whom they pointed out had served them.

Mr. Barrett objected to this as evidence, saying that it was a remark not made in the presence of Neale, but the Magistrate overruled the objection. In evidence, iNeale: stated that, he did not have the keys to the bar, did not serve HquoT on. the night in question, and had not seen the two men before., He said this to the constable when asked on March 3 if he had served the men. Neale said he was the nephew of the licensee, and sometimes served in the bar. . ..-■' '

The Magistrate, imposed a fine as stated above.
