WRONGFUL EXCLUSION

ADMISSION TO UNION
(By Telegraph.—Press Association.) TIMAKU, This Day. A reserved judgment of Mr. Justice Kennedy was delivered today in the Supreme Court in. an, action in which George Richard Blatch and Joseph Kyle claimed damages against the management committee of the Timaru "Wharf Labourers' Union for alleged wrongful exclusion from,membership and for a writ of mandamus to admit them as members of'the union.
The Judge held that there was no proof .that what was mentioned as a previous limitation of the membership to 130 was accepted by the New Zealand Waterside Workers' Federation. In any event, if limitation, was proved, it wonld not apply to the period from August; 1932, to January, 1933, when there was no current award. Thus the plaintiffs .prov.ed their right to membership, and the defendants failed to prove ; any valid limitation affecting the membership current at all relevant periods.
Judgment was entered for. the plaintiffs for £20 each, with costs, and a writ of mandamus was granted for their admission to the union.
