THEFT CHARGE FAILS
CASE INCOMPLETE
(By Telegraph.—Press Association.) HAMILTON, March 12. Holding that thero was insufficient evidence on which- to commit the defendant for trial, the Magistrate (Mr. S. L. Paterson) dismissed the charge of theft against Frederick George Voyle, aged 36, formerly an agent for the New Zealand Co-operative Pig Marketing Association, Hamilton, in the Police Court today. Evidence was called to show that tho accused was given £498 19s, which was paid into an imprest account upon which he was to operate for purchasing j calves on behalf of the association. On IVoyle's engagement being terminated, he was asked for the return of scales, books, etc. The imprest account cheque book was not returned, and £58 13s was unaccounted for. The Magistrate said that in order to establish a case, the prosecution must show that the accused, in violation of good faith, committed an offence and fraudulently applied some of the money for some other purpose. The Court had no explanation of what had become' of the money. The case was too incomplete" \o-send the accused for trial.
