O'DUFFY'S LIABILITY

CASE BEFORE HIGH COURT

DUBLIN, January 24 . The Attorney-General, Mr. McGuire, applied to the High Court to remove, with costs, against General O'Duffy the prohibitory order of the High Court on January 1. ■ The Court was crowded and there was a full Bar on both sides, i Mr. McGuire, replying to Mr. Justice Hanna, gave an interpretation as to j the Legislature's intentions regarding the creation of the military tribunal and the scope thereof. His Honour pointed out that membership of an unlawful association was an offence, but the summons against O'Duffy indicated a retrospective offence. No Act of Parliament could be retroactive. ' The case was adjourned.

On January 1 the High Court granted a conditional prohibition . preventing the military tribunal from hearing and determining the charges against General O'Duffy, leader of the United Ireland Party, on the ground that the charges were outside the tribunal's jurisdiction, also that the charges of unlawful association did not involve a legal offence.
