COMPENSATION CLAIM

A. claim for compensation was made 5n the Arbitration Court today by .I'OBsie Smart against the Wellington Publishing Company. •, In her statement of claim, tlie plaintiff said she was the widow of Andrew Kmart, a compositor employed by the defendant-company. On or about September 29, 1932, Smart fell down a flight, of stairs and was injured. The injuries included bruises and an abrasion, of tlie little toe of his right foot. The toe became septic, and was amputated. Subsequently the leg had to be amputated above the knee owing to the spread of the septic or gangrenous condition. Smart died on Juno 14, 1033. The plaintiff claimed £1000 compensation, £50 funeral and medical expenses, aiid costs. The defeneo -was a general denial of Ihc allegations in the statement of claim. Mr. C. J. O'.Regan appeared for the plaintiff and Mr. W. E. Leicester for the defendant company. Mr. O''Began admitted that the exact date of the accident could iiot be proved. Mr. Leicester said'that Smart did not sco a medical man until October 17. His Honour Mr. Justice Frazer said it was admitted that after the accident Smart worked for a fortnight. Mr. O'Kegan said that Mrs. Smart ■bathed and attended to her husband's injured foot prior to the time ho went into hospital. Evidence was given in support of the plaintiff's claim. The medical testimony showed that in addition to the injured foot, Smart suffered from arteriosclerosis or thickening of the walls of the arteries, which would delay the cure of an injured foot. The hearing was proceeding at the luncheon adjournment.
