NEW TRIAL DECLINED

With a unanimous decision, Judges of the Court of Appeal, at the conclusion of legal argument yesterday afternoon, dismissed an application made on behalf of John James arid Patrick Ryan for an order .directing. a new trial ■on ■ a criminal charge. James and Ryan were found guilty in the Supreme Court at Auckland last month by a jury on a charge of assaulting James McCormick at Pukekohe with the intention of robbing him. •

The application for a new trial was based on the. ground that the, jury's verdict was against the weight of evidence, but the Court held, after hearing legal argument, that there was evidence upon which the jury were entitled to act, and which justified them in finding the accused guilty. The Court comprised the Chief Justice (Sir Michael Myers), Mr. Justice Reed, ■and Sir- Justice Ostler. Mr. W. Noble, of Auckland, appeared fov James and Ryan, and the Solicitor/ General (Mr. A. Fair, K.C.) for the Crown. .
