A JURY'S VERDICT
APPLICATION FOR NEW
TRIAL
On the ground that the jury's verdict was against the -weight of evidence, an order directing a new trial was sought on behalf of John James and Patrick Byanin the Court of Appeal today. x James and i Byan were found guilty at ' the Supreme Court, Auckland, last month on a charge of assaulting James McCoriniek at Pukekohc withthe intention of robbing him. The application was heard 'by the Chief Justice (Sir Michael Myers), Mr. Justice Beed, and Mr. Justice Ostler. Legal argument had not. concluded at the time of going to press. ■
Mr. W. Noble, of Auckland, appeared in support of the application,, and the Crown was represented by the SolicitorGeneral (Mr. A. Fair, K.C.).
Mr. Noble said that the case differed from most cases of v the kind he had been able to find, in so far as there was no conflict at all between the parties as to tho evidence. It was not a case in which the jury accepted the evidence of one set of witnesses in preference to another set of witnesses. The accused accepted all the evidence, but it was contended that' it: did riot support the1 verdict of guilty found by the jury, but a verdict that' they were innocent. : :
