INJURED KNEE
COMPENSATION- CLAIM
The Arbitration Court today Wd a claim for compensation made by Frank Harris, waterside worker, against the Union Steam Ship Co., Ltd. Mr Jus. tice Frazer presided, and the assessors ;Monteith. Mr. F. W. Ongley. appeared +£ sla5 la'nti ft ' and C. G. White for the defendant company According to the statement of claim, the plaintiff was working on the steamer Waipiata. on September 15, 1932, when a hogshead of beer slipped and jammed his right knee against the coamings Tha plaintiff said he had suffered total incapacity, and would remain incapacitated ior an indefinite period. He claimed weekly payments of £2 16s 3d for total incapacity, computed into a lump sum - , *he, defence was a denial that the plaintift s knee was jammed against the coamings as alleged, and asserted that thai plaintiff m avoiding the hogshead of beer slipped and fell against the hatch coamings. Total incapacity was admitted up to on or about November IS, 1932, and then it was alleged, he was fit to reauina employment. Between November 18 and December 19, 1932, he was fit to do light work. The company had paid into Court the sum of £5 12s Bd. which they asserted was sufficient compensation for the period referred to.
His Honour: The questions at issue ara simply the extent of the injury-'and the amount of compensation. Medical evidence was taken as to tha extent of the injury. After retirement, his Honour said-the Court had decided to treat the plaintiff on the basis of being neurasthenic, and to award him full compensation to data and for a further period of thirteen weeks, and costs, £10 10s.
