CLAIM FOR DAMAGES

INJURIES TO BOATMAN

Injuries allegedly received by a Harbour Board boatman at KarOii On the night of August 25 last, through the negligence of a motorist, were the basis of a claim for damages heard in the Supreme Court yesterday afternoon and today by the Chief Justice (Sir Michael Myers) and a jury. The plaintiff was Norman McLeod, who claimed special and general damages amounting to £382 Os 6d against William E. Trott, a lubricating engineer, employed by tho Texas Oil Co., Ltd. Mr. C. A. L. Treadwell, with Mr. R. L. A. Cresswell, appeared for the plaintiff, and Mr. W. P. Rollings for tho defendant. It was alleged by the plaintiff that when he was crossing from Tringham Street to catch a tram on tho main Karori Road he was run down by a motor-car as a result of negligence by tho defendant. He said he wa3 seriously injured and had not yet completely recovered. The statement of defence contained a general denial of the plaintiff's allegations. It was contended that if there was a collision it was caused by negligence on the part of the plaintiff. Evidence is now being heard.
