HEAVY TRAFFIC FEES

APPORTIONMENT INQUIRY

Under the motor lorry regulations the apportionment of heavy traffic fees within a heavy traffic district is to be settled either by agreement among the local authorities concerned, or, in default of agreement, by a Magistrate. Mr. E., Page, S.M., is engaged today in hearing an application by the Hutt County Council to have tho apportionment of the heavy traffic fees in the Wellington district decided, by a Magistrate.

Mr. A. Gray, K.C., is appearing for the Hutt County Council, Mr. 11. Johnston, K.C., and Mr. R. E. Harding for the Petone Borough Council, the Lower Hutt Borough Council, the Eastbourne Borough Council, the Jolmsonville Town Board, and tho Makara County Council, the City Solicitor, Mr. J. O'Shea, . and Mr. J. Lockie for the Wellington City Council, and Mr. E. P. Hay for the Upper Hutt Borough Council.

At the outset Mr. Johnston contended that the jurisdiction of the Magistrate's Court could not be extended or restricted by regulation, and the Magistrate, if he acted in tho present case, was acting simply in his private capacity. Any order he made, therefore, would not be enforcable. Legal argument is proceeding. •
