'"The police have been trying to srap» press Sunday trading. A number of shops have been openjy flouting the law,, and we have received complaints from other shopkeepers. My instructions are to ask for a substantial penalty, and the full penalty for persons who come before the Court for the second time," said Sub-In-spector Shanahan, when charges of selling fruit on Sunday and exposing, fruit- for sale on Sunday were brought in the Police Court against Florence Cunningham. There was a further charge of selling goods on Sunday against Patrick Cunningham, husband of the other defendant. It was stated that the defendants occupied a. shop in Park road, opposite the Auckland Hospital.
Mr. Blomfield, who represented the defendants, said the shop had been.opened only during the visiting hours at the hospital, and on each occasion purchasers were asked -whether the goods were for hospital patients. On each occasion Cunningham was assured that they were. Th» fruit sold was chiefly oranges.
Counsel then produced a petition signed by 200 hospital patients, -which was to be presented to Parliament, asking that pro* vision should be made for- the sale of! goods for hospital patients on Sundays. The Magistrate, Mr. F. K. Hunt, said the^Hospifcal Board might be able to sel? fruit and other refreshments at the hos« pital.
Stating that lie had been mstrnc.ted ■*• ask for a substantial penalty, the subriaspector said a sergeant had called at_ the defendants' shop, and they had taken,no notice of him, even when he told them who he was. Both the defendants had been selling fruit as fast as they could, and had continued to, keep the shop open o» the following Sunday
Mr. Blomfield again urged that the <!ei fendants were selling fruit' for hospita* patients. ' / The Magistrate: "Yes, and for profit foj themselves.
