ADVERTISING ACCOUNT

JUDGMENT FOR "THE POST"

A. claim by Blundell Bros., Ltd., for £3110s owing on a^n advertising account was defended in the Magistrate's Court yesterday by Thomas Eowell, of the Vienna Cake Shop. The claim, arose out of the publication of a prospectus of company, which : was to be floated to take over Eowell ,'s business, and in defence he contended that the responsibility for: the payment of the account rested with Maurice Goldsborough, who acted as broker, .and who was joined with Eowell as a co^defendaiit.

Aftef hearing evidence, Mr. E; Page, S.M., said that it: had been shown that Goldsborough instructed "The Post" to put in, the advertisement, and when he was asked for an authority he produced a slip signed by Bowell. "It seems difficult to imagine a ease in which the fact of the agency is stronger than this," Mr.: Page said. "It seems clear to me that Bowell instructed Goldsborough to put iii the "advertisement, and ■I« entertain no doubt that "The Post" is entitled to judgment against Eowell. Judgment was given for the plaintiff for the full amount claimed, with costs amounting to. £7 7s. Judgment was also given in favour of Goldsborough against Bowell. for costs, £2 2s.

' Mr. A. Free appeared for Blundell Bros., .Ltd.,. Mr. J.. S...Banna for Eowell, and ,Mr. .-A;. M., -..Causing. ...for. GoHlsborough. ;..■■,.'■".' : •■ •
