REGRETTABLE INCIDENT
JURYMEN AND WITNESSES
NEW TRIAL ORDERED
' (By. Telegraph.—Press Association.) '■'-•'. ' - DUNEDIN, This Day.. When a 'charge of. sheep-stealing against- Gilbert. William Lewis was resumed at the Supreme Court, Mr. Adams, tho Crown Prosecutor, said: "1 have been informed that last night, when the Court rose, the foreman of the jury, and one juryman got into company., with two witnesses for tho defence, and went with them to a hotel bar, where they were for some time in conversation. They were seen there by detectives. " . Counsel applied to either have the jury discharged or for the ease to continue with the ten remaining jurymen. Detective Sneddon stated that, he saw' the foreman of the jury drinking with two defence witnesses. Another juryman was 'present. He did not hear what was said. Mr. Justice Kennedy said that it was a regrettable incident and-regrettable for, the accused, because thero must be a new trial, with the unfortunately'attendant expense and inconvenience. He ordered the discharge of the jury without a verdict, and directed that a new jury be empanelled nest Monday. Tho Judge added that as the jurymen had not been heard, lie would take the view that their conduct was due to a misapprehension of their duties.
