The hearing of the co -msation: claims of Arthur Henry Gibson and Annie Ellen Gibson for £420 and £2080 respectively in.respect of land taken.by the City.-Cor-porationat Ngaio for recreation purposes, was concluded lata yesterday afternoon before the Compensation. Court—-hia Honour Mr. Justice Ostler" (chairman) and Messrs. J.- M. Dale and E. Bold (assessors) —and judgment was given by his Honour to-day. • "
To Arthur Henry Gibson £350 was awarded in full settlement of all claims, a condition of the award being that the claimant should not be called upon to contribute towards the cost of any boundary fencing. Kespondent to pay the costs of claimant, which ■ were fixed at £21, with witness's, expenses and disbursements, including the ■ fees ; of both assessors, "which were fixed at five guineas, witness's expenses to be fixed by the Registrar if the parties could not agree.
In the cae of Annie iEUen Gibson, judgment was given for £850 in full settlement of all claims, with the same condition aB to boundary fencing. As the award was not half the amount of the claim, each party would have to pay its own costa and its own assessor's fees, which were fixed at seven guineas each. His Honour stated that it was a majority verdict, the claimant's assessor not agreeing to it. , At the hearing, Mr. A." Wiren appeared for the claimants, and Mr. J. O'Shea (City Solicitor) lor the Corporation.
