Aii aß'egution of the usu of loaded dieo saiol to have been made by one wharf la-bourcr against another' led to a scuffle aboard tho liner Mahana recently, and the scqncl was heard in tho Magistrate's Court to-day, when Mathias Ellison charged Ludwig Larsen with assault.
Mr. E. Page, S.M., hoard tho case, Air. \V. P. Boilings appearing for Ellison, and Mr. H. K. Bollard for Larsen.
The facts were that the informant is employed as a .foreman stevedore by the Shaw, Savill, and Albion Company, and on the day of the alleged assault he was supervising the loading of cargo in the Mahana. The defendant came aboard the ship, and after speaking to Ellison struck him, it was alleged, without any warning. Larsen alleged that Ellison struck him first, the trouble being over whether Ellison said that Larsen had carried loaded dice. In tho course of the struggle it was alleged that Ellison tried to put Larseu over the ship's rail on to the wharf, a distance of about fourteen feet. v
After hearing the evidence of a number of witnesses on either side, Mr. Page said that tha evidence showed that Larsen went on board the ship to demand something of the naturo of an apology. "He went, I think, 1' said tha Magistrate, "with his mind somewhat inflame*! at tho suggestion made against him, and, I think, he went looking for trouble. . . . Looking at the whole of tho i'acts, I think Larsen was the aggressor, throughout the whole of this affair, and I must convict him on this chargo of assault."
Larsen was fined £2, and ordered to pay the costs,; which amounted to £4 Ss.
