OVER A LEASE

Judgme:^ was delivered by Mr. Justice MacGregor in the Supreme Court yesterday afternoon in the case in which Spiro Bardebea claimed a declaration that Mrs. Annie Sykes was not enttiled to a renewal of the lease of his premises on Wellington terrace. Bardebes also asked that the defendant should give up possession of too premises, and he claimed £200, the «O6t of necessary repairs. ~ His Honour said he found that the defendant had faUed to pay the rwl punctually, and had failed to repair the premises in terms of the lease. He made a declaration that the defendant was not entitled to a renewal of the lease, »nd made an order for possession. In regard to a counter-claim by the defendant, his Honour said that Mr. Gr. F. Woodward, the previous owner, effected such repairs as had been agreed on, and Mr. Sykes was satisfied. Thereupon the lease was executed, and an agreement which the defendant alleged had Deen «n----tered into became merged, and was controlled by the lease. Mr. W. E. Leicester, who apepared for Mrs. Sykes, said that in view of the judgment he would abandon the counter-claim and he consented to judgment in connection with the repairs for £150. Mr. P. S. K. Macassey appeared foi Bardebes.
