ABOUT A LEASE

DISPUTE OVER REPAIRS.

Mr. Justice MacGregor was engaged in the Supreme Court yesterday in hearing a dispute regaapling the upkeep of a property on Wellington terrace. The parties were Spiro Bardebes, plaintiff, and Mrs. Annie Sykes, defendant. Mrs. Sykes leased a' property from Bardebes, and the latter contended that she had failed to pay the rent punctually, and had not effected repairs in terms of the lease. Bardebes claimed a declaration, that the defendant was not entitled to a renewal of the lease, and asked that' the defendant Blrould give up possession of the premises. Ho further claimed £200, the cost of the necessary repairs. In a counter-claim, the defendant said that the repairing covenant contained in the lease was controlled and rendered inoperative by a prior agreement by which George Frederick Woodward, the previous owner, agreed to do the necessary repairs. The repairs were, never carried out by Woodwood, nor by the plaintiff, who was notified that the agreement had not been fulfilled by Woodward, and that tne obligations devolved upon the plaintiff. The defendant claimed a renewal of the lease, and sought £500 damages. Mr. P. S. K. Macassey appeared for Bardebes, and Mr. W. E. Leicester for Mrs. Sykes. After hearing lengthy evidence, the case was adjourned till to-day.
