SENTENCE REDUCED
(By Telegraph.) (Special to "The Evening Post.") AUCKLAND, 3rd September. The Teoent appeal by Joseph Mercer, a motor mechanic, against the sentence of a month's imprisonment, imposed by Mr. F. K. Hunt, S.M., for negligent driving, which resulted in the death of one passengor and injurieß to two others near Papakura on 22nd June was the subject of a judgment this morning by Mr. Justice Herdman, who intimated he was of the opinion Mr. Hunt was right in deciding that the appellant bad been guilty of negligence. Counsel applied for a substitution of a fine for imprisonment. His Honour said that h» wu not | satisfied that Mich jurisdiction was given by sectii 2 of the Justices of the Peace Act < 1923, and refused the application, bui reduced th« sentence to ten days in view of Mercer* good character and the fact that,there was no suspicion that the accident was due to drink.
