He had seen the car outside the hotel 'some tfme before, while he himself was passing on a tramcar. The office of the hotel wafs in.the private liai", and defendant, (jiving evidence on his own behalf said that on the evening in question he took the licensee of the hotel to a theatre, and took him back to the hotel about 10.30. As defendant had no change, the licensee took him inside and paid his fare. There was a bit of talk about the various artists, but he had nothing to drink, and had even left the engine of his car running while he went into the hotel. His Worship considered the'explanation sufficient. The defendant was quite entitled to go into the .hotel'to get his fare, and was evidently on friendly terms with the licensee and bis family, whose premises were close to his.
