CIVIL CASES.

JUDGMENT BY DEFAULT. Plaintiffs were given judgment by default of defendants in the following cases, before Dr. . M' Arthur, S.M., today : — N-ew Zealand Express Co., Ltd. v. J. Maginnity, £2 12s, costs lls ; Sophia Towersley v. Arthur Howell, £419s 3d. coste 10s; The New Zealand Times- Co., Ltd. v. P. L. Harnett, J313 19s, costs £1 10s 6d ; J. A. Smythe v. George Dunkinson, £1 Is, costs ss ; The Atlas Biscuit and Confectionery Co. v. Geo. Dunkinson 2 £49 9s 2d, costs £3 7s 6d ; Elviss Pointon v. J. de Courcy Brady, £7, ooste £1 6s 6d ; Palmer Engineering Co., Ltd. v. C. L. Zimmerman £10 14e 9d, costs £1 10s 6d. DEFENDED -CASE. W. H. Edwards and Son, builders and contractors, of Wellington, sued James Maher, settler, of Ohingaiti, for £38 5s 6d, alleged to be due for work done and material supplied. Defendant counterclaimed for £27 17s 9d for goods supplied to the plaintiff. Mr. E. J. Fitzjibbon appeared for plaintiff, and Mr. H. E. "Evans for defendant. After hearing evidence his Worship gave judgment on the claim for £20 15s 6d, the amount of a cheque which defendant had drawn in favour of plaintiff -when, the latter agreed to waive the claim for the balance (£l7 10b) of the account. The cheque was not cashed, as defendant Ejabsequeirtly stopped payment at the bank. Costs amounting to £4 17s were allowed. Judgment was also given for defendant on the counter claim, with solicitor's fee £1 Is.
