RESIDENT MAGISTRATE'S COURT. (Before C. D. R. Ward, Esq., R.M.)
A. Langley, D. Barry, and S. Ramus, summoned Mr. John Martin for 10s, 7s 6d> and 10s respectively. In satisfaction of these demands, defendant paid into court the sums of 2s, 4s, and 2s. Plaintiffs were employed in carrying furniture from the Panama Hotel to Mr. Martin's store, and when the work was finished were tendered payment at the rate of 2s per load, which they refused accepting, and hence the cause of action. Plaintiffs alleged 5s per hour was paid by furniture dealers for use of their vans, Without demur. Mr. Martin's clerk deposed that 2s per load was what he paid other men on the day plaintiffs were engaged, and a similar sum on every other occasion, never paying more. The Magistrate considered he was bound by the usage of the place, which was proved to be 2s per load, and gave judgment accordingly, with costs. Had plaintiffs in. tended to demand more, they should have stipulated for it when being employed. Jane Benge, aged 14 years, was charged with plucking flowers from a grave in the Cemetery on Sunday last, and acknowledged having done so, believing at tho time there was no harm in it. Mr. Ward explained to her ttiat the offence she had committed was a theft, and having reprimanded her inflicted the small penalty of half-a-crown, on the girl making a promise never again to pluck flowers from the graves. This Dat. John Kelly and John Greaves, for drunkenness, were fined —the former 20s, and the latter 10s. Julius Seehoff and Myer Casselberg, lottery office keepers, for unlawful gaming. This was an adjourned case from 25th November, the parties being admitted to bail—themselves in the sum of £100, and one surety in a like sum. On appearing in Court to-day> the case against them was dismissed. The following debt cases were disposed of :— Whisker v. Robertson, debt 18s 3£d—judgment '07 consent. Same v. Cumin, £4 13s 9d —judgment for plaintiff for amount and costs. Forster v. Booth, 14s—amount and costs paid into court.
