John Brigharn was charged with being drank, on horseback, on the public streefijjn and fined 10s. Caleb Cull, proprietor of the Freemasons' Hotel, was charged with allowing his chimney to take fire. The Inspector said that this was the fourth time he had done so lately.— Fined 40s. W. Osborne v. William Camm ; claim £10, being part of the price of a horse sold to defendant by plaintiff on the 9th inst. Plaintiff stated that defendant paid jEIO when he took the horse away, and promised to pay the balance when he arrived in Wellington, but did not do so. Plaintiff did not give any warrant of the soundness of the horse at the time of sale. Defendant disputed the claim on the grounds that the horse was not what plaintiff represented it to be at the time of sale, it being unsound. When he took it home, the horse took ill. He adopted the usual remedies, but they failed, and the horse died soon after. The Bench being of opinion that defendant ought to have satisfied himself of the condition of the horse before he purchased it, gave judgment for plaintiff in full amount with costs. W. Turnbull v. Josiah Minifle ; claim £25 for goods delivered — Judgment by consent for amount with costs. William Clerk v. Peter Garrick ; claim £5 is lod with interest— Judgment for amount with costs.
