LICENSING ACT, 1881.
In view of tbo elections of persons to compose the bodies termed “The Licensing Coniraittess,” and whoso duty it will be to hold a court for the consideration of all licenses under the above Act, wc purpose giving by way of general information a slight summary of the provisions of the Act relating to the Committees and the elections of same.
Section 11 says: —“No person shall be qualified to be elected or to act as a member of a Licensing Committee who is a brewer, wine or spirit merchant, milster, distiller, importer for sale of, or a dealer in liquors, or in partnership with any such person, or who acts as the agent or auctioneer or any such person ; who is in te - rested in any such business, or in any such house or building o'- promises as mot tgagee or otherwise; who is the owner in fee or for any less estate of tiny licensed house, or house or building nr premises in which any trade in or manufacture of liquor is carried on ; who has within fonryeats been a bankrupt or insolvent, an I has pail a less dividend than 10s in the pound upon his debts. No person sba'l he qualified to be elected or to act as a member of a Licensing Committee during the time he holds a paid otlice under t.e Government of the Colony or under the council of any county or borough ” Beet on 12 provilcs that “any person so qnalilied, acting or sitting a- a member of a Licensing Committee, shall be liable to a penalty of £Dd for every such offence.”
Section 13 says the Committee shall consist of live pur-cns, who may lie residents cither within or outside the district, to he clccr.nl annually hy the ratcpayeis of the dis rict in m inner provided by “The Regulation of Local Elections Act 1"71> ” Notice of the election is given hy advertiseinent Each ratepayer shall ouiy have one vote In case any district shall fail or neglect to, elect a Licensing Committee at the time appointed, the (Jovernor slia 1 appoint same The quorum of a Licensing Committee sha 1 he thiee members inclusive of the chairman. The chairman is to he elected at the first meeting and shall have a casting as well as a deliberative vote All licenses held at the commencement of this Act are stibj ct to its provisions Licensing meetings are to lie held on such one of the first ten days in December, March, June, and September as shall be appointed hy the Returning Officer in each district The Juno meeting is the annual meeting, and new licenses and renewals shall be grained only at the animal meeting Ten or more residents in the district may object to granting cf a license by petition, one or more householders in tlie neighborhood of premises proposed. to be licensed, and the police may object personal!), and the governing body of the town or district may nominate some some person to object to the granting of a license The annual fees to be paid for licenses are as follows : Publican’s license within the limits of a borough £4l), outside a borough, £25 ; wine license £1 ; accommodation licen-e not exceeding £2O ; bottle license, £4'f; wholesale license, £2 ! ; conditional license accorniug to duration of time not exceeding £3O.
